Singapore's Odex Subs Haruhi with Similar Text to Fansub

Excerpts of Odex's translation identical to earlier unauthorized release

Fans are reporting that Singaporean licensor Odex's release of The Melancholy of Haruhi Suzumiya anime series contains translation excerpts identical to an earlier unauthorized subtitled video released by the a.f.k. group. Representatives of Odex have yet to comment in the ongoing discussions (with comparison images) on this topic on its official forums. Similar situations have occurred in North America, although in some cases, they were the results of former fansubbers working professionally.
According to various nations' laws (standardized internationally through the Berne Convention), translations are derivative works and remain subject to the authorization and copyrights of the original owners — in this case, Nagaru Tanigawa, Noizi Ito, and "member of SOS" (the real production committee named after the story's fictional club).

SINGAPORE: PacNet need not reveal anime downloaders' names
Anime distributor Odex is denied access to the details of PacNet's subscribers

Anime distributer Odex has lost a court bid to force Pacific Internet to reveal names of subscribers who allegedly downloaded pirated versions of the Japanese cartoons.
The Subordinate Court handed down its decision in chambers yesterday and no details were made public.


Pacific Internet (PacNet), which opposed the Odex action, would only say that it "respects the rights of intellectual property owners and at the same time, also believes in protecting the privacy of all our subscribers."

The Straits Times understands one reason for District Judge Ernest Lau's decision is that he believes Odex was not the right party to make the application, despite having the go-ahead to prosecute on behalf of the Japanese anime studios.

Odex is demanding the names of up to 1,000 PacNet downloaders. A company spokesman said it will consult the rights owners before making its next move but it was likely to appeal. It has 14 days to do so.

The ruling yesterday came as a surprise given that Odex had successfully obtained court orders to get SingNet and StarHub to reveal names of their downloaders.
Different judges ruled on those cases, and both Internet service providers declined to say what arguments they presented in court.


In light of the PacNet decision, a StarHub spokesman said yesterday that it was "assessing our options...given the different decisions rendered by the court."
But the deadline for lodging an appeal has expired for SingNet.

Internet industry observer James Seng cautioned that it would be "dangerously presumptuous" to assume the ruling meant Odex's case against downloaders was weak, or that PacNet's argument was applicable in other cases.

Judge Lau, even as he denied Odex the court order, is understood to have warned that the right to privacy was no defence for copyright infringement.

Odex distributes popular anime like Gundam and Inuyasha here.
In May, it launched what would become Singapore's largest reported crackdown on illegal downloads.


Its first move was to send letters to 17 SingNet users accusing them of illegally downloading anime and demanding a settlement of between $3,000 and $5,000.
Downloaders using other Internet service providers had initially thought that only SingNet users were targeted.


But earlier this month it was disclosed that Odex had also obtained a court order to force StarHub to reveal the names of hundreds more alleged downloaders.
A trickle of online complaints about the firm soon escalated into death threats and an avalanche of vitriolic forum posts criticising Odex.


The mood was not helped when Odex director Stephen Sing was found to have made disparaging remarks about the alleged illegal downloaders who had received legal letters from the firm.

True right? Odex didnt have right to catch everyone, with their "copyright". I believe at most they can, is only to catch people who download anime that Odex sold in Singapore. The Odex and anime lovers fight so far, we can see a wise judge here. As long as, we dont download things related to Odex, it will be save I think...

Account Suspended

Haiz, what a bad day. This morning, I found out that my YouTube account had be suspended due to the third time violating the copyright material... I am currently requesting YouTube to recover my account but I heard that it is impossible. I am awaiting fot YouTube to reply me. I have 41 working videos and 10 subscribers, and vidoes being viewed in several sites. I will be disappointing if YouTube banned me. Worst to worst I may have to refind a new channel to keep you guys in on my animes. Haix...
